Welcome to Jhema Wears (“Jhema”, “we”, “us”, “our”). These Terms & Conditions (“Terms”) govern your access to and use of our website, products, and services (collectively, the “Services”). By using the Services, you agree to these Terms. If you do not agree, please do not use the Services.

1) Eligibility & Account

• You must be of legal age to form a binding contract in your jurisdiction to place an order.
• Information you provide must be accurate and complete. You are responsible for maintaining the confidentiality of your account and credentials, and for all activities under your account.
• We may suspend or terminate accounts for suspected fraud, abuse, or violation of these Terms.

2) Orders, Acceptance & Availability

• Your order is an offer to purchase. We accept only when we dispatch the item(s) and send a shipping confirmation.
• We may refuse or cancel any order (e.g., due to availability, pricing/description error, suspected fraud, or regulatory restrictions). If we cancel after payment, we’ll issue a refund.
• Quantities may be limited. Some products may be available in limited runs or be subject to pre-order timelines.
• Colors and finishes may vary slightly due to screen settings and natural material variation.

3) Pricing, Currency, Taxes & Duties

• Prices are shown in your selected display currency and may change at any time without notice.
• Taxes, duties, and import fees may apply depending on your destination and will be shown at checkout where possible or collected on delivery by the carrier or customs.
• We reserve the right to correct pricing or typographical errors. If a pricing error is identified after you place an order, we may cancel and refund or contact you for confirmation at the corrected price.

4) Payments & Security

• We accept major cards (e.g., Visa, MasterCard, American Express, Discover). All transactions are processed via our secure payment gateway.
• For your security, we do not store full card numbers on our servers.
• Orders are subject to verification. We may request additional information to validate identity and prevent fraud.

5) Shipping, Delivery & Risk of Loss

• Processing Time: 1–2 business days before shipping.
• Standard Delivery Time: 10–14 working days (Mon–Fri, excluding public holidays). Express: approx. 5–7 working days. Timelines are estimates and may vary due to customs, carrier delays, peak periods, or remote locations.
• Domestic Nigeria Shipping: billed per kilogram by state. Minimum chargeable weight: 1.0 kg.
• International Shipping: billed per kilogram by destination (DHL export zones). Minimum chargeable weight: 0.5 kg. Special tiered rates may apply for certain countries/weights when available.
• At checkout, we automatically calculate the best available rate using your destination and total cart weight. If your cart is below the minimum chargeable weight for your destination, checkout will prompt you to adjust before payment.
• Risk of loss passes to you upon delivery to the shipping address you provide. Title transfers upon our receipt of full payment.

6) Returns, Exchanges & Refunds

• Returns are accepted within 7 days of delivery for full-price items in original, unworn condition with all tags attached.
• Final sale items and personalized/customized products are not eligible for return.
• To exchange, please initiate a return for the original item and place a new order for the replacement.
• Refunds are issued to the original payment method within 30 business days of receiving and inspecting your return.
• International returns may have duties/fees deducted where applicable.

7) Promotions & Gift Cards

• Promotional offers are time-limited, subject to change, and may not be combined unless expressly stated.
• Gift cards (if offered) are non-refundable and may be subject to region-specific terms or expiry where permitted by law.

8) Intellectual Property

• All content on our website—including designs, imagery, logos, product names, graphics, text, and code—is the property of Jhema Wears or its licensors and is protected by applicable laws.
• You may not copy, reproduce, publish, distribute, modify, or create derivative works without prior written permission.

9) User Content & Acceptable Use

• If you submit reviews, photos, or other content, you grant Jhema a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display such content for the purpose of operating, marketing, and improving the Services.
• You agree not to post unlawful, misleading, infringing, or harmful content, and not to misuse the site (e.g., scraping, reverse engineering, introducing malware, or attempting unauthorized access).
• We may moderate or remove content at our discretion.

10) Disclaimers & Warranties

• Except as expressly stated, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee uninterrupted or error-free operation, nor that defects will be corrected, nor that the site or servers are free of viruses or harmful components.
• Nothing in these Terms limits any non-waivable statutory rights you may have under applicable law.

11) Limitation of Liability & Indemnity

• To the fullest extent permitted by law, Jhema Wears and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to your use of the Services.
• Our aggregate liability for any claim relating to the Services will not exceed the amount you paid for the product(s) giving rise to the claim.
• You agree to indemnify and hold Jhema Wears harmless from claims arising from your breach of these Terms or misuse of the Services.

12) Governing Law & Disputes

• These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict-of-laws principles.
• Exclusive jurisdiction and venue shall lie in the courts of Lagos State, Nigeria, unless mandatory consumer protection laws in your jurisdiction require otherwise.
• Before filing suit, the parties agree to attempt to resolve disputes informally by contacting the other party and allowing a reasonable time to respond.

13) Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms on this page with a new “Last updated” date. Your continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
